By accessing or using EVMerx ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. EVMerx is an AI-powered marketplace connecting electric vehicle (EV) owners with energy providers.
2. Description of Service
EVMerx provides a platform that enables:
- EV owners to find and book charging services from registered providers
- Energy providers to list their charging services and manage bookings
- AI-assisted matching between energy requests and available providers
- Secure payment processing through our integrated payment system
- Real-time communication between parties
3. User Accounts
To use certain features of the Platform, you must create an account. You agree to provide accurate information, maintain the security of your credentials, notify us of any unauthorized access, and be responsible for all activities under your account.
4. Provider Responsibilities
If you register as an energy provider, you agree to provide accurate information about your charging services, maintain safe and functional equipment, honor confirmed bookings and pricing, comply with all applicable laws, and respond to booking requests in a timely manner.
5. EV Owner Responsibilities
As an EV owner using the Platform, you agree to provide accurate information about your vehicle and charging needs, arrive at scheduled appointments on time, treat provider equipment with respect, complete payment as agreed, and report any issues promptly.
6. Payments and Fees
EVMerx facilitates payments between EV owners and providers. A platform fee of 1% is applied to each transaction. Payments are processed securely through Stripe. Providers receive payouts according to our payout schedule. Refunds and disputes are handled according to our dispute resolution process.
7. AI Features
EVMerx uses artificial intelligence to enhance the user experience including matching algorithms, automated assistance, and dispute resolution support. While we strive for accuracy, AI recommendations are provided as suggestions and users maintain final decision-making authority.
8. Dispute Resolution
In the event of a dispute between users, EVMerx provides an AI-assisted dispute resolution process. Decisions made through this process are binding. Users agree to engage in good faith efforts to resolve disputes before escalating to formal resolution.
9. Limitation of Liability
EVMerx acts as a platform connecting users and is not responsible for the actions of individual users. We do not guarantee the quality, safety, or legality of services offered by providers. To the maximum extent permitted by law, EVMerx shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform.
10. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of modified terms.
